PROPOSED FISCAL YEAR 2026 BUDGET FOR THE COUNTY OF MAUI (BFED-1)
Description
The Committee is in receipt of the following:
1. Correspondence dated March 25, 2025, from Mayor Richard T. Bissen, Jr., relating to the proposed Fiscal Year (“FY”) 2026 Budget for the County of Maui. Included in the Mayor’s transmittal are the following:
a. Bill 41 (2025), entitled “A BILL FOR AN ORDINANCE RELATING TO THE OPERATING BUDGET FOR THE COUNTY OF MAUI FOR THE FISCAL YEAR JULY 1, 2025 TO JUNE 30, 2026.” Bill 41’s purpose is to appropriate estimated revenues for the operating and capital improvement budget. Incorporated within Bill 41 are Appendix A, which lists Grants and Restricted Use Revenues and Special Purpose Revenues; Appendix B, which is the Schedule of Fees, Rates, Assessments, and Taxes; Appendix B-1, which lists the County’s concessions, leases, and licenses by department; and Appendix C, which provides descriptions of Capital Improvement Projects (“Budget bill”).
b. Bill 42 (2025), entitled “A BILL FOR AN ORDINANCE RELATING TO THE CAPITAL PROGRAM FOR THE FISCAL YEAR ENDING JUNE 30, 2026.” Bill 42’s purpose is to set forth the Capital Program for FYs 2026 through 2031. Incorporated within Bill 42 are Appendix A-1, a report entitled “COUNTY OF MAUI, CAPITAL IMPROVEMENT PROJECTS REPORT, AS OF DECEMBER 31, 2024,” which lists all pending capital improvement projects and appropriations, except for Water Fund projects, as of December 31, 2024; Appendix A-2, a report entitled “County of Maui, Capital Improvement Program by District Job and Index, Fiscal Year Ending 06/30/2025 - as of 12/31/2024,” which includes pending Water Fund capital improvement projects and appropriations as of December 31, 2024; and Appendix B, which is the proposed Capital Program for FYs 2026 through 2031 (“Capital Program bill”).
c. Bill 43 (2025), entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE ISSUANCE OF ONE HUNDRED TWENTY MILLION FIVE HUNDRED SEVEN THOUSAND TWO HUNDRED EIGHTY-FOUR DOLLARS ($120,507,284) AGGREGATE PRINCIPAL AMOUNT OF GENERAL OBLIGATION BONDS OF THE COUNTY OF MAUI FOR THE PURPOSE OF PROVIDING FUNDS TO PAY ALL OR A PART OF THE COST OF APPROPRIATIONS FOR PUBLIC IMPROVEMENTS OF AND FOR THE COUNTY OF MAUI; FIXING THE FORM, DENOMINATIONS AND CERTAIN OTHER FEATURES OF SUCH BONDS AND PROVIDING FOR THEIR SALE; AUTHORIZING THE DIRECTOR OF FINANCE TO DETERMINE CERTAIN DETAILS OF THE BONDS; AUTHORIZING THE ISSUANCE AND SALE OF A LIKE PRINCIPAL AMOUNT OF GENERAL OBLIGATION BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE AND SALE OF SUCH BONDS; AUTHORIZING THE ISSUANCE OF REFUNDING GENERAL OBLIGATION BONDS OF THE COUNTY; AND PROVIDING FOR OTHER ACTIONS RELATED TO THE ISSUANCE, SALE AND DELIVERY OF SAID BONDS.” Bill 43’s purpose is to authorize the issuance of $120,507,284 in general obligation bonds for various capital improvement projects (“Bond Authorization bill”).
d. Bill 44 (2025), entitled “A BILL FOR AN ORDINANCE DETERMINING THAT PART OF THE PROCEEDS OF GENERAL OBLIGATION BONDS OF THE COUNTY OF MAUI HERETOFORE ISSUED IS IN EXCESS OF THE AMOUNTS REQUIRED FOR THE PURPOSES FOR WHICH SUCH BONDS WERE INITIALLY ISSUED, OR MAY OR SHOULD NOT BE APPLIED TO THOSE PURPOSES, AND DIRECTING SUCH PROCEEDS TO OTHER PUBLIC IMPROVEMENTS OR AUTHORIZED PURPOSES OF THE COUNTY OF MAUI.” Bill 44’s purpose is to reauthorize the use of $3,926,861 in lapsed bond proceeds for the Department of Environmental Management, West Maui Community Plan Area, Sewer, Lahaina Wastewater Reclamation Facility Returned Activated Sludge (RAS)/Dewatering Upgrades; and Department of Water Supply, Countywide, Water Supply, Countywide Upgrades and Replacements (“Lapsed Bond bill”).
e. Bill 45 (2025), entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE MAYOR OF THE COUNTY OF MAUI TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR A LOAN FROM THE STATE OF HAWAII’S WATER POLLUTION CONTROL REVOLVING FUND FOR VARIOUS WASTEWATER PROJECTS, FISCAL YEAR 2026 BUDGET ORDINANCE.” Bill 45’s purpose is to authorize the Mayor to enter into an intergovernmental agreement to finance the Waiko Road Subdivision Sewer System and the Kīhei Wastewater Pump Station No. 7 Relocation with funds not to exceed $11,900,000.
f. Bill 46 (2025), entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE MAYOR OF THE COUNTY OF MAUI TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR A LOAN FROM THE STATE OF HAWAII’S WATER POLLUTION CONTROL REVOLVING FUND FOR VARIOUS WATER SUPPLY PROJECTS, FISCAL YEAR 2026 BUDGET ORDINANCE.” Bill 46’s purpose is to authorize the Mayor to enter into an intergovernmental agreement to finance Countywide Upgrades and Replacements with funds not to exceed $3,000,000.
g. Resolution 25-83, entitled “ADOPTING THE FUEL TAX RATES FOR THE COUNTY OF MAUI, EFFECTIVE JULY 1, 2025.” Resolution 25-83’s purpose is to adopt the fuel tax rates for the County of Maui, effective July 1, 2025, in accordance with Section 243-5, Hawaii Revised Statutes, and Section 3.20.010, Maui County Code.
h. A document entitled “FISCAL YEAR 2026 MAYOR’S PROPOSED BUDGET,” which includes the Mayor’s Budget Message, as required by Section 9-2(1) of the Revised Charter of the County of Maui (1983), as amended (“Program Budget”).
2. Bill 48 (2025), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.44.015, MAUI COUNTY CODE, RELATING TO SALARIES OF DEPUTIES CORPORATION COUNSEL AND DEPUTIES PROSECUTING ATTORNEY.” Bill 48’s purpose is to amend Section 2.44.015, Maui County Code, to revise the salaries of deputies corporation counsel and deputies prosecuting attorney.
3. Bill 49 (2025), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.08.060, MAUI COUNTY CODE, ON SALARIES IN THE OFFICE OF COUNCIL SERVICES.” Bill 49’s purpose is to amend Section 2.08.060, Maui County Code, to revise the salary pay plan and pay ranges for the Office of Council Services.
4. Resolution 25-89, entitled “SETTING THE SALARY FOR THE DIRECTOR OF COUNCIL SERVICES FOR THE REMAINDER OF THE 2025-2027 COUNCIL TERM.” Resolution 25-89’s purpose is to set the salary of the Director of Council Services.
5. Resolution 25-90, entitled “SETTING THE SALARY FOR THE DEPUTY DIRECTOR OF COUNCIL SERVICES FOR THE REMAINDER OF THE 2025-2027 COUNCIL TERM.” Resolution 25-90’s purpose is to set the salary of the Deputy Director of Council Services.
6. Bill 50 (2025), entitled “A BILL FOR AN ORDINANCE REPEALING CHAPTER 3.26, MAUI COUNTY CODE, RELATING TO EMPLOYEE PARKING FEES FUND.” Bill 50’s purpose is to repeal the Employee Parking Fees Fund and transfer all encumbrances and any balance remaining in the Employee Parking Fees Fund to the General Fund.
7. Bill 54 (2025), entitled, “A BILL FOR AN ORDINANCE AMENDING SECTION 3.12.070, MAUI COUNTY CODE, TO REQUIRE COMMUNITY WORKFORCE AGREEMENTS FOR LARGE CAPITAL IMPROVEMENT PROJECTS OF MORE THAN $500,000.” Bill 54’s purpose is to require responsible bidders be signatories to the community workforce agreement for all capital improvement project contracts of more than $500,000.
Status
The Committee may consider whether to recommend passage on first reading of each of the following bills with or without revisions: Bill 41 (2025), Bill 42 (2025), Bill 43 (2025), Bill 44 (2025), Bill 45 (2025), Bill 46 (2025), Bill 48 (2025), Bill 49 (2025), Bill 50 (2025), and Bill 54 (2025). The Committee may also consider whether to recommend adoption of Resolutions 25-83, 25-89, and 25-90, with or without revisions. The Committee may also consider the development of other legislation related to the proposed budget for FY 2026. The Committee may also consider whether to recommend the filing of Bill 41 (2025), Bill 42 (2025), Bill 43 (2025), Bill 44 (2025), Bill 45 (2025), Bill 46 (2025), Bill 48 (2025), Bill 49 (2025), Bill 50 (2025), Bill 54 (2025), and Resolutions 25-83, 25-89, and 25-90 and other related action.
Note
With reference to this agenda item, one or more executive meetings may be held in accordance with Section 92-5(a), Hawaii Revised Statutes (“HRS”):
1. to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in Section 26-9, HRS, or both;
2. to consider the hire, evaluation, dismissal, or discipline of an officer or employee or of charges brought against the officer or employee, where consideration of matters affecting privacy will be involved; provided that if the individual concerned requests an open meeting, an open meeting shall be held;
3. to deliberate concerning the authority of persons designated by the County, the Council, or the Committee to conduct labor negotiations or to negotiate the acquisition of public property, or during the conduct of such negotiations;
4. to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee;
5. to investigate proceedings regarding criminal misconduct;
6. to consider sensitive matters related to public safety or security;
7. to consider matters relating to the solicitation and acceptance of private donations; and
8. to deliberate or make a decision upon a matter that requires the consideration of information that must be kept confidential pursuant to a State or Federal law, or a court order.
