RESOLUTION 26-110, REFERRING TO THE MAUI PLANNING COMMISSION PROPOSED BILLS TO AMEND THE KIHEI-MAKENA COMMUNITY PLAN AND WEST MAUI COMMUNITY PLAN, AND TO CHANGE THE ZONING FOR CERTAIN TIMESHARE, LEASEHOLD, AND OTHER PROPERTIES IN THE A-1 AND A-2 APARTMENT DISTRICTS  (HLU-18)

 

Description

The Committee is in receipt of the following:

 

1.                     Resolution 26-110, entitled “REFERRING TO THE MAUI PLANNING COMMISSION A PROPOSED BILL TO AMEND THE KIHEI-MAKENA COMMUNITY PLAN AND WEST MAUI COMMUNITY PLAN AND A PROPOSED BILL TO CHANGE THE ZONING FOR CERTAIN TIMESHARE, LEASEHOLD, AND OTHER PROPERTIES IN THE A-1 AND A-2 APARTMENT DISTRICTS.”  Resolution 26-110’s purpose is to refer to the Maui Planning Commission a proposed bill to amend the Kihei-Makena Community Plan and West Maui Community Plan and a proposed bill to change the zoning for 1) properties with a mix of Timeshare and Transient Vacation Rental uses; 2) leasehold properties; and 3) properties with less than five units and values difficult for the average potential homeowner to afford, to allow for continued Transient Vacation Rental uses.  The Community Plan Amendment bill would amend the Kihei-Makena Community Plan to designate applicable properties as Hotel and the West Maui Community Plan to designate applicable properties as Resort/Hotel.  The Change in Zoning bill would grant a Change in Zoning to the H-3 Hotel District for applicable properties in the A-1 Apartment District and to the H-4 Hotel District for applicable properties in the A-2 Apartment District.

2.                     Correspondence dated June 25, 2026, from the Committee Chair, transmitting a list entitled “Apartment District Properties Allowed to be Used for Short-Term Occupancy,” dated June 27, 2024.  The same list is attached to the agenda as Exhibit “1.”

 

Status

The Committee may consider whether to recommend adoption of Resolution 26-110, with or without revisions.  The Committee may consider revising Resolution 26-110 to add properties consistent with the Resolution’s purpose to the attached proposed bills from the list of Apartment District properties attached to the agenda as Exhibit “1.”  The Committee may also consider revising Resolution 26-110 to remove properties from the attached proposed bills.  The Committee may also consider the filing of Resolution 26-110 and other related action.
