Title

RESOLUTION 26-15, AUTHORIZING THE EMPLOYMENT OF MCCORRISTON MILLER MUKAI MACKINNON LLP, AS SPECIAL COUNSEL IN TODD P. LYNAM, ET AL. V. COUNTY OF MAUI, ET AL.; CIVIL 2CCV-25-0003780, AND IN ANY FUTURE LITIGATIONS CHALLENGING ORDINANCE 5909 (2025)  (GREAT-11(27))

 

Description

The Committee is in receipt of the following:

1.                     Resolution 26-15, entitled “AUTHORIZING THE EMPLOYMENT OF MCCORRISTON MILLER MUKAI MACKINNON LLP, AS SPECIAL COUNSEL IN TODD P. LYNAM, ET AL. V. COUNTY OF MAUI, ET AL., CIVIL CASE 2CCV-25-0003780, AND IN ANY FUTURE LITIGATIONS CHALLENGING ORDINANCE 5909 (2025).”  Resolution 26-15’s purpose is to authorize the employment of McCorriston Miller Mukai MacKinnon LLP as special counsel to assist and represent as co-counsel the County of Maui, Department of Planning, and Kate Blystone in her official capacity, or her successor, as Director of Planning, with the Class Action Complaint for Declaratory and Injunctive Relief in Todd P. Lynam, et al., v. County of Maui, et al., Civil 2CCV-25-0003780 and in any future litigations challenging Ordinance 5909 (2025), for a total compensation not to exceed $250,000.

2.                     Correspondence dated January 20, 2026, from the Department of the Corporation Counsel, transmitting a copy of the Complaint, filed on December 22, 2025.

 

Status

The Committee may consider whether to recommend adoption of Resolution 26-15 with or without revisions.  The Committee may also consider the filing of Resolution 26-15 and other related action.

 

Note

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaiʻi Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee; and Section 92-5(a)(8), Hawaiʻi Revised Statutes, to deliberate or make a decision upon a matter that requires the consideration of information that must be kept confidential under a State or Federal law, or a court order.
