Title

BILL 37 (2025), AMENDING THE FISCAL YEAR 2025 BUDGET:  ESTIMATED REVENUES; CAPITAL IMPROVEMENT PROJECTS (DEPARTMENT OF WATER SUPPLY); APPENDIX A, PART II, GENERAL EXCISE TAX FUND; AND APPENDIX C (DEPARTMENT OF MANAGEMENT AND DEPARTMENT OF WATER SUPPLY); AND BILL 38 (2025), AMENDING CHAPTER 3.100, MAUI COUNTY CODE, RELATING TO THE GENERAL EXCISE AND USE TAX SURCHARGE (BFED-34)

 

Description

The Committee is in receipt of the following:

1.                     Bill 37 (2025), entitled “A BILL FOR AN ORDINANCE AMENDING THE FISCAL YEAR 2025 BUDGET FOR THE COUNTY OF MAUI, ESTIMATED REVENUES; CAPITAL IMPROVEMENT PROJECTS, DEPARTMENT OF WATER SUPPLY; APPENDIX A, PART II, GENERAL EXCISE TAX FUND; AND APPENDIX C, DEPARTMENT OF MANAGEMENT AND DEPARTMENT OF WATER SUPPLY.”  Bill 37’s purpose is to amend the Fiscal Year 2025 Budget by: 

1)                     Amending Section 2, Estimated Revenues, by increasing Licenses/Permits/Others by $25,000,000;

2)                     Amending Section 4.H.1.a.(1), Department of Water Supply, Countywide, Water Supply, Water Fund - Restricted, by adding two new appropriations entitled “Water Supply Infrastructure Repairs and Replacements (GET Fund),” in the amount of $10,000,000, and “Integration of Public and Private Water Systems (GET Fund),” in the amount of $10,000,000, respectively;

3)                     Amending Section 4.H.2.a.(1), Department of Water Supply, Makawao-Pukalani-Kula Community Plan Area, Water Supply, Water Fund - Restricted, by adding a new appropriation entitled “Kamole Water Treatment Plant Filter Replacement (GET Fund),” in the amount of $5,000,000;

4)                     Adjusting the totals accordingly;

5)                     Amending Appendix A, Part II, Special Purpose Revenues - Schedule of Revolving/Special Funds for Fiscal Year 2025, General Excise Tax Fund, by:

a)                     Clarifying that the funds in condition (1) for the Kamole Weir Water Treatment Facility and condition (7) for the acquisition of water systems and wells will be transferred to the Department of Water Supply;

b)                     Amending condition (5) to delete language relating to water infrastructure repairs and replacement and to decrease the condition amount from $16,668,000 to $6,668,000; and

c)                     Adding a new condition (8) to read as follows:  “Up to $10,000,000 must be for water infrastructure repairs and replacement related to the August 2023 Wildfires.  Transfer to Department of Water Supply;”

6)                     Amending Appendix C - Capital Improvement Projects, Department of Management, Countywide, Water Supply Infrastructure Repairs and Replacements and Wastewater Collection System Repairs, by:

a)                     Revising the name of the project to “Wastewater Collection System Repairs;”

b)                     Deleting language from the project description relating to repairs and replacement of water-related infrastructure; and

c)                     Decreasing the appropriation from $16,668,000 to $6,668,000; and

7)                     Amending Appendix C - Capital Improvement Projects, Department of Water Supply, Countywide, by adding a new project and project description entitled “Water Supply Infrastructure Repairs and Replacements” in the amount of $16,668,000.

2.                     Bill 38 (2025), entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 3.100, MAUI COUNTY CODE, RELATING TO THE GENERAL EXCISE AND USE TAX SURCHARGE.”  Bill 38’s purpose is to amend Chapter 3.100, Maui County Code, by:

1)                     Amending Section 3.100.020, Maui County Code, to require that 80 percent of all funds derived from the County’s General Excise and Use Tax Surcharge will be deposited into the General Excise Tax Fund;

2)                     Amending Section 3.100.021, Maui County Code, to require that 20 percent of all funds derived from the County’s General Excise and Use Tax Surcharge be deposited into the General Excise Tax Fund - Department of Hawaiian Home Lands; and

3)                     Amending Section 3.100.040, Maui County Code, to provide for funding for water-related projects from either fund to be transferred to the Department of Water Supply for the duration of the project and for remaining funds to be re-deposited in the appropriate fund at the conclusion of the project.

 

Status

The Committee may consider whether to recommend passage of Bill 37 (2025) and Bill 38 (2025) on first reading, with or without revisions.  The Committee may also consider the filing of Bill 37 (2025) and Bill 38 (2025) and other related action.
