RESOLUTION 26-129, REFERRING TO THE MAUI PLANNING COMMISSION PROPOSED BILLS TO AMEND THE KIHEI-MAKENA COMMUNITY PLAN AND WEST MAUI COMMUNITY PLAN, AND TO CHANGE THE ZONING FOR A-1 AND A-2 APARTMENT DISTRICT PROPERTIES IN THE SEA LEVEL RISE EXPOSURE AREA  (HLU-20)

 

Description

The Committee is in receipt of the following:

1.                     Resolution 26-129, entitled “REFERRING TO THE MAUI PLANNING COMMISSION A PROPOSED BILL TO AMEND THE KIHEI-MAKENA COMMUNITY PLAN AND WEST MAUI COMMUNITY PLAN AND A PROPOSED BILL TO CHANGE THE ZONING FOR A-1 AND A-2 APARTMENT DISTRICT PROPERTIES IN THE SEA LEVEL RISE EXPOSURE AREA.”  Resolution 26-129’s purpose is to refer to the Maui Planning Commission a proposed bill to amend the Kihei-Makena Community Plan and West Maui Community Plan and a proposed bill to change the zoning for Apartment District properties in the Sea Level Rise Exposure Area to allow for continued Transient Vacation Rental uses.  The Sea Level Rise Exposure Area is determined by using the County’s recognized planning threshold for coastal erosion at 3.2 feet of sea level rise as identified in the Hawai‘i Sea Level Rise Viewer.  The Community Plan Amendment bill would amend the Kihei-Makena Community Plan to designate applicable properties as Hotel and the West Maui Community Plan to designate applicable properties as Resort/Hotel, and make conforming amendments to the community plans’ text.  The Change in Zoning bill would grant a Change in Zoning to the H-3 Hotel District for applicable properties in the A-1 Apartment District and to the H-4 Hotel District for applicable properties in the A-2 Apartment District.

 

The properties affected are:

a.                     Island Sands, 150 Hauoli Street, Mā‘alaea, Hawai‘i;

b.                     Maalaea Kai, 70 Hauoli Street, Mā‘alaea, Hawai‘i;

c.                     Kihei Bay Surf, 715 South Kihei Road, Kīhei, Hawai‘i;

d.                     Kihei Bay Vista, 679 South Kihei Road, Kīhei, Hawai‘i;

e.                     Lokelani, 3833 Lower Honoapiilani Road, Lahaina, Hawai‘i;

f.                     Hale Ono Loa, 3823 Lower Honoapiilani Road, Lahaina, Hawai‘i;

g.                     Pikake, 3701 Lower Honoapiilani Road, Lahaina, Hawai‘i; and

h.                     Hale Kai I, 3695 Lower Honoapiilani Road, Lahaina, Hawai‘i.

 

2.                     An Amendment Summary Form, dated July 30, 2026, from the Committee Chair, to add a new section to the proposed Community Plan Amendment bill attached as Exhibit “1” to the resolution, to conform the Kihei-Makena Community Plan text at Part V, A, “Land Use Categories and Definitions,” for the “Hotel (H)” designation.

 

3.                     Correspondence dated July 30, 2026, from the Committee Chair, transmitting a list entitled “Apartment District Properties Allowed to be Used for Short-Term Occupancy,” dated June 27, 2024. The same list is attached to the agenda as Exhibit “1.”

 

Status

The Committee may consider whether to recommend adoption of Resolution 26-129, with or without revisions.  The Committee may consider revising Resolution 26-129 to add properties consistent with the Resolution’s purpose to the attached proposed bills from the list of Apartment District properties attached to the agenda as Exhibit “1.” The Committee may also consider revising Resolution 26-129 to remove properties from the attached proposed bills. The Committee may also consider the filing of Resolution 26-129 and other related action.
