BILL 29 (2024) AND BILL 30 (2024), DISTRICT BOUNDARY AMENDMENT AND CHANGE IN ZONING FOR OHUKAI LIGHT INDUSTRIAL PARK (KĪHEI) (HLU-27)
Description
The Committee is in receipt of the following:
1. Bill 29 (2024), entitled “A BILL FOR AN ORDINANCE TO AMEND THE STATE LAND USE DISTRICT CLASSIFICATION FROM AGRICULTURAL TO URBAN FOR PROPERTY SITUATED AT KIHEI, MAUI, HAWAII TAX MAP KEY (2) 3-9-001:034.” Bill 29’s purpose is to grant a District Boundary Amendment from Agricultural District to Urban District for 14.626 acres located at 454 Ohukai Road, Kīhei, Maui, Hawaiʻi, identified for real property tax purposes as tax map key (2) 3-9-001:034 (por.), for the development of Ohukai Light Industrial Park.
2. Bill 30 (2024), entitled “A BILL FOR AN ORDINANCE TO CHANGE ZONING FROM RURAL TO M-1 LIGHT INDUSTRIAL (CONDITIONAL ZONING) FOR PROPERTY SITUATED AT KIHEI, MAUI, HAWAII TAX MAP KEY (2) 3-9-001:034.” Bill 30’s purpose is to grant a conditional Change in Zoning from County Rural District to M-1 Light Industrial District for 14.626 acres located at 454 Ohukai Road, Kīhei, Maui, Hawaiʻi, identified for real property tax purposes as tax map key (2) 3-9-001:034 (por.), for the development of Ohukai Light Industrial Park.
3. Correspondence dated January 31, 2024, from the Planning Director, transmitting the Department of Planning’s report and recommendations from the Maui Planning Commission and related documents.
4. Correspondence dated June 13, 2024, from the Committee Chair to the Planning Director, requesting clarification and review of the following:
a. Bill 29, CD1 (2024), entitled “A BILL FOR AN ORDINANCE TO AMEND THE STATE LAND USE DISTRICT CLASSIFICATION FROM AGRICULTURAL DISTRICT TO URBAN DISTRICT FOR PROPERTY SITUATED AT KĪHEI, MAUI, HAWAIʻI, PORTION OF TAX MAP KEY (2) 3-9-001:034”; and
b. Bill 30, CD1 (2024), entitled “A BILL FOR AN ORDINANCE TO CHANGE ZONING FROM COUNTY RURAL DISTRICT TO M-1 LIGHT INDUSTRIAL DISTRICT (CONDITIONAL ZONING) FOR PROPERTY SITUATED AT KĪHEI, MAUI, HAWAIʻI, PORTION OF TAX MAP KEY (2) 3-9-001:034.”
The proposed CD1 versions of Bill 29 and Bill 30 incorporate technical and nonsubstantive revisions.
5. Correspondence dated June 27, 2024, from the Planning Director, responding to correspondence dated June 13, 2024, from the Committee Chair. The correspondence includes a corrected Land Zoning Map L-5126, attached as Exhibit “B,” and responses to the Committee Chair’s questions relating to the Conditions of Zoning, attached as Exhibit “C,” to Bill 30 (2024).
6. Correspondence dated July 23, 2024, from William Spence, transmitting a presentation entitled “Ohukai Light Industrial Park, District Boundary Amendment, Change of Zoning”.
Status
The Committee may receive a presentation from William Spence, on behalf of the applicants. The Committee may consider whether to recommend passage on first reading of the proposed CD1 versions of Bill 29 (2024) and Bill 30 (2024), referenced in paragraph 4 above, with or without revisions. The Committee may also consider the filing of Bill 29 (2024) and Bill 30 (2024) and other related action.
