BILL 126 (2023), RELATING TO FLOOD HAZARD AREAS (WAI-17)
Description
The Committee is in receipt of Bill 126 (2023), entitled “A BILL FOR AN ORDINANCE REPEALING CHAPTER 19.62, MAUI COUNTY CODE, AND CREATING A NEW CHAPTER 16.29, MAUI COUNTY CODE, RELATING TO FLOOD HAZARD AREAS.” Bill 126’s purposes are to: 1) repeal Chapter 19.62 - Flood Hazard Areas from Title 19, 2) establish Chapter 16.29 - Flood Hazard Areas in Title 16, 3) change the responsibility for administering Flood Hazard Areas from the Director of Planning to the Director of Public Works, and 4) include the Federal Emergency Management Agency’s requirement that all machinery and equipment servicing a building be elevated to one foot above the base flood elevation.
Status
The Committee may consider whether to recommend passage of Bill 126 (2023) on first reading, with or without revisions. The Committee may also consider the filing of Bill 126 (2023) and other related action.
