RESOLUTION 25-201, SETTLEMENT AUTHORIZATION: COUNTY OF MAUI, DEPARTMENT OF ENVIRONMENTAL MANAGEMENT V. KOMAR MAUI PROPERTIES I LLC, CASE 1:24-CV-00203-KJM  (GREAT-11(23))

 

Description

The Committee is in receipt of the following:

1.                     Resolution 25-201, entitled “AUTHORIZING SETTLEMENT OF COUNTY OF MAUI, DEPARTMENT OF ENVIRONMENTAL MANAGEMENT V. KOMAR MAUI PROPERTIES I LLC, CASE 1:24-CV-00203-KJM.” Resolution 25-201’s purpose is to approve settlement of County of Maui, Department of Environmental Management v. Komar Maui Properties I LLC, Case 1:24-cv-00203-KJM.  Komar Properties is seeking abandonment damages under Section 101-27, Hawai‘i Revised Statutes, after the County withdrew claims for eminent domain of the subject property identified as Tax Map Key (2) 3-8-003-020 on or about November 18, 2024.

2.                     Correspondence dated October 24, 2025, from the Department of the Corporation Counsel, transmitting a copy of the Complaint.

 

Status

The Committee may consider whether to recommend adoption of Resolution 25-201, with or without revisions. The Committee may also consider the filing of Resolution 25-201 and other related action.

 

Note
