SOCIAL HOST LIABILITY (DRIP-9(9))
Description
Under Rule 7(B) of the Rules of the Council, the Committee intends to review Chapter 9.40, Maui County Code, on social host liability, including Bill 17 (2026), which would repeal the chapter in its entirety. Bill 17 (2026) remains with the Council for consideration of passage on first reading.
Status
The Committee may review Code Chapter 9.40, the status of its administrative enforcement, and Bill 17 (2026) with the Department of Police. The Committee may also discuss other related matters. No legislative action will be taken.

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawai‘i Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee; and Section 92-5(a)(6), Hawai‘i Revised Statutes, to consider sensitive matters related to public safety or security.
