CASE UPDATES AND RESOLUTIONS RELATED TO LEO CAIRES V. COUNTY OF MAUI, ET AL., CIVIL FILE 2CCV-26-0000138 (GREAT-11(30))
Description
The Committee is in receipt of Resolution 26-99, entitled “REQUIRING THE COUNTY’S LEGAL COUNSEL IN LEO CAIRES V. COUNTY OF MAUI, ET AL., CIVIL FILE 2CCV-26-0000138, TO TRANSMIT ALL WRITTEN SETTLEMENT OFFERS UNDER MAUI COUNTY CODE SECTION 3.16.020.” Resolution 26-99’s purpose is to require the County’s legal counsel to transmit all written settlement offers to the Council and send all invoices to the Office of Council Services for review and approval.
Status
The Committee may receive comments from a representative of Marr Jones & Wang, LLLP regarding the filing of the lawsuit, including a status update, and discuss related matters. The Committee may also consider whether to recommend adoption of Resolution 26-99, with or without revisions. The Committee may also consider the filing of Resolution 26-99 and other related action.

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaiʻi Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee; and Section 92-5(a)(8), Hawaiʻi Revised Statutes, to deliberate or make a decision upon a matter that requires the consideration of information that must be kept confidential pursuant to a State or Federal law, or a court order.
