Title

BILL 78 (2026), AMENDING TITLE 19, MAUI COUNTY CODE, ON ACCESSORY DWELLINGS ON RESIDENTIALLY ZONED LOTS  (HLU-12)

 

Description

The Committee is in receipt of the following:

1.                     Bill 78 (2026), entitled “A BILL FOR AN ORDINANCE AMENDING TITLE 19, MAUI COUNTY CODE, ON ACCESSORY DWELLINGS ON RESIDENTIALLY ZONED LOTS.”  Bill 78’s purpose is to allow for the construction of at least two accessory dwelling units for residential use on residentially zoned lots, consistent with Section 46-4.8, Hawaiʻi Revised Statutes.

2.                     Correspondence dated May 11, 2026, from the Planning Director, transmitting the Department of Planning’s report, planning commissions’ recommendations, and other related documents.

3.                     An Amendment Summary Form, dated May 20, 2026, from the Committee Chair, with a proposed CD1 version of Bill 78 (2026).  The proposed CD1 version incorporates the planning commissions’ recommended amendments and nonsubstantive revisions.

4.                     An Amendment Summary Form, dated May 27, 2026, from Councilmember Tamara Paltin, to add a new section to the bill stating that, “This Ordinance does not affect conditional-zoning ordinances that were enacted under Section 19.510.050, Maui County Code, before its effective date.”

 

Status

The Committee may consider whether to recommend passage of Bill 78 (2026) on first reading, with or without revisions.  The Committee may also consider the filing of Bill 78 (2026) and other related action.
