Title

BILL 1 (2026), AMENDING THE WATER AVAILABILITY POLICY ON SUBDIVISION CONSTRUCTION PLANS   (WAI-21)

 

Description

The Committee is in receipt of the following:

1.                     Bill 1 (2026), entitled “A BILL FOR AN ORDINANCE AMENDING THE WATER AVAILABILITY POLICY ON SUBDIVISION CONSTRUCTION PLANS.”  Bill 1’s purpose is to allow a subdivider, at its own risk of water availability, to submit construction plans for review by the Department of Water Supply before the verification of a private or public long-term supply of water.

2.                     An Amendment Summary Form, dated July 28, 2026, from the Committee Chair, with a proposed CD1 version of Bill 1 (2026).  The proposed CD1 version:

1)                     Amends Section 1 to state that the written verification requirement for a long-term water supply must not delay the Department of Water Supply’s review of, and comments on, subdivision construction plans.

2)                     Amends Subsection 14.12.040(A), Maui County Code, by restoring the language regarding written verification requirements.

3)                     Adds a new Subsection C to Code Section 14.12.040, stating that the required written verification must not delay the Director’s review of and comments on subdivision construction plans, and that such review may proceed concurrently with other departmental reviews and comments.

4)                     Makes nonsubstantive and technical revisions for clarity, consistency, and style.

 

Status

The Committee may consider whether to recommend passage of Bill 1 (2026) on first reading, with or without revisions.  The Committee may also consider the filing of Bill 1 (2026) and other related action.
