BILL 55 (2025), ON CODE OF ETHICS VIOLATIONS AND PENALTIES (GREAT-9)
Description
The Committee is in receipt of the following:
1. Bill 55 (2025), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.56.010, MAUI COUNTY CODE, RELATING TO THE CODE OF ETHICS, VIOLATION - PENALTY.” Bill 55’s purpose is to give the Board of Ethics jurisdiction to pursue violations of Article 10 of the Revised Charter of the County of Maui (1983), as amended, for up to six years after an officer or employee separates from County employment for acts committed while employed with the County.
2. An Amendment Summary Form, dated July 16, 2026, from the Committee Chair, with a proposed CD1 version of Bill 55 (2025), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.56.010, MAUI COUNTY CODE, ON CODE OF ETHICS VIOLATIONS AND PENALTIES.” The proposed CD1 version: 1) amends the bill’s title; 2) adjusts the jurisdictional window to begin when the alleged violation occurred; and 3) extends the Board of Ethics’ jurisdiction to six years from the date the alleged violation is discovered or reasonably should have been discovered for violations concealed by fraud.
Status
The Committee may consider whether to recommend passage of Bill 55 (2025) on first reading, with or without revisions. The Committee may also consider the filing of Bill 55 (2025) and other related action.
