BILL 110 (2024), AMENDING SECTION 16.25.201, MAUI COUNTY CODE, RELATING TO IMPROVEMENTS TO PUBLIC STREETS (WAI-27)
Description
The Committee is in receipt of the following:
1. Bill 110 (2024), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 16.25.201, MAUI COUNTY CODE, RELATING TO IMPROVEMENTS TO PUBLIC STREETS.” Bill 110’s purpose is to exempt properties destroyed or damaged by the August 8, 2023, Maui wildfires, where the cost to rebuild or repair the structure will exceed 50 percent of the replacement value of the structure as of August 8, 2023, from the requirement of improving public streets.
2. An Amendment Summary Form, dated October 10, 2025, from the Committee Chair, with a proposed CD1 version of Bill 110 (2024), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 16.25.201, MAUI COUNTY CODE, RELATING TO IMPROVEMENTS TO PUBLIC STREETS.” The proposed CD1 version:
1) Replaces the exception for “any property where a structure was destroyed or damaged by the August 8, 2023, Maui wildfires” with a more limited exception applying only to structures on Front Street properties located between Shaw Street and Baker Street within Maui County Historic Districts No. 1 or 2, that were destroyed or damaged by a declared emergency or disaster.
2) Incorporates nonsubstantive and technical revisions for clarity, consistency, and style.
3) Is approved as to form and legality by the Department of the Corporation Counsel.
Status
The Committee may consider whether to recommend passage of Bill 110 (2024) on first reading, with or without revisions. The Committee may also consider the filing of Bill 110 (2024) and other related action.
