BILL 1 (2026), AMENDING THE WATER AVAILABILITY POLICY ON SUBDIVISION CONSTRUCTION PLANS   (WAI-21)

 

Description

The Committee is in receipt of the following:

1.                     Bill 1 (2026), entitled “A BILL FOR AN ORDINANCE AMENDING THE WATER AVAILABILITY POLICY ON SUBDIVISION CONSTRUCTION PLANS.” Bill 1’s purpose is to allow a subdivider, at its own risk of water availability, to submit construction plans for review by the Department of Water Supply before the verification of a private or public long-term supply of water.

2.                     An Amendment Summary Form, dated January 20, 2026, from the Committee Chair, with a proposed CD1 version of Bill 1 (2026), entitled “A BILL FOR AN ORDINANCE AMENDING THE WATER AVAILABILITY POLICY AND SUBDIVISION ORDINANCE ON SUBDIVISION CONSTRUCTION PLANS.”  The proposed CD1 version:

a.                     Amends the bill’s title.

b.                     In Section 14.12.040, Maui County Code, separates the proposed provisions on submittal of subdivision construction plans before written verification of water availability into a new Subsection B; and specifies in the existing Subsection A that the final subdivision approval being referenced is under Section 18.20.180.

c.                     Amends Code Section 18.20.160 to cross-reference Subsection 14.12.040(B).

d.                     Amends Code Section 18.20.180 to remove the reference to Section 14.12.040 from the first sentence and specify that the Director of Water Supply must provide the written verification required by Code Subsection 14.12.040(A) before final subdivision approval.

 

Status

The Committee may consider whether to recommend passage of Bill 1 (2026) on first reading, with or without revisions.  The Committee may also consider the filing of Bill 1 (2026) and other related action.
