ACQUISITION OF MAUI LAND & PINEAPPLE COMPANY, INC.’S WATER INFRASTRUCTURE ASSETS IN WEST MAUI AND UPCOUNTRY (DRIP-9(12))
Description
Under Rule 7(B) of the Rules of the Council, the Committee intends to discuss with the Department of Management and Department of Water Supply a non-binding Memorandum of Understanding, dated May 18, 2026, between the County of Maui and Maui Land & Pineapple Company, Inc., on the potential acquisition of certain real property and water infrastructure assets in West Maui and Upcountry.
Status
The Committee may discuss the Memorandum of Understanding and status of negotiations. The Committee may also discuss other related matters. No legislative action will be taken.
Note
With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(3), Hawai‘i Revised Statutes, to deliberate concerning the authority of persons designated by the County, the Council, or the Committee to conduct labor negotiations or to negotiate the acquisition of public property, or during the conduct of such negotiations; and Section 92-5(a)(4), Hawai‘i Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee.
