Title

BILL 100 (2026), TO ESTABLISH COMPREHENSIVE LOBBYIST REGULATIONS  (GREAT-16)

Description

The Committee is in receipt of the following:

1.                     Bill 100 (2026), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.56.040, MAUI COUNTY CODE, TO ESTABLISH COMPREHENSIVE LOBBYIST REGULATIONS.”  Bill 100’s purpose is to establish comprehensive lobbyist regulations, including registration, training, reporting requirements, restricted activities, and penalties.

2.                     An Amendment Summary Form, dated October 13, 2026, from the Committee Chair, with a proposed CD1 version of Bill 100 (2026), entitled, “A BILL FOR AN ORDINANCE AMENDING SECTION 2.56.040, MAUI COUNTY CODE, TO ESTABLISH COMPREHENSIVE LOBBYIST REGULATIONS.” The proposed CD1 version: 1) corrects the Ramseyer formatting of Section 2.56.040; 2) removes references to training requirements; 3) amends the definition of “legislative action” in Subsection 2.56.040(A) to include matters before council committees; 4) clarifies that, under specified circumstances, the exceptions apply to individuals representing themselves, but not to individuals representing another person before an executive-branch agency; 5) clarifies that the reporting exemptions under Subsection 2.56.040(G)(3)(j) apply to the receipt or expenditure of money to influence the election or defeat of a candidate for elective office or the passage or defeat of a measure at a special or general election; 6) confirms the Board’s authority and jurisdiction by referencing Code Section 2.56.010; 7) removes the proposed $5,000 penalty for each violation and instead references the penalties under Section 2.56.010, Maui County Code; and 8) incorporates nonsubstantive revisions for clarity, consistency, and style.
