LITIGATION MATTERS (SETTLEMENT AUTHORIZATION:  AVID AMIRI, INDIVIDUALLY AND AS TRUSTEE OF THE DEUTSCHE INTERNATIONAL TRUST II V. COUNTY OF MAUI, CIVIL 19-CV-00373) GREAT-11(39)

 

Description

The Committee is in receipt of the following:

1.                     Governance, Ethics, and Transparency Committee Report 20-71, which was recommitted by the Council at its meeting of July 10, 2020.

2.                     Correspondence dated December 22, 2020, from the Department of the Corporation Counsel, transmitting a revised proposed resolution entitled “AUTHORIZING SETTLEMENT OF AVID AMIRI, INDIVIDUALLY AND AS TRUSTEE OF THE DEUTSCHE INTERNATIONAL TRUST II VS. COUNTY OF MAUI, CIVIL 19-CV-00373.”  The purpose of the revised proposed resolution is to authorize settlement of the claim.  The claimant alleges negligence with the construction, inspection, maintenance, and repair of the culvert and roadway providing access to 372 Puu Way, Haiku, Maui, Hawaii.

 

Status

The Committee may consider whether to recommend adoption of the revised proposed resolution, with or without further revisions.  The Committee may also consider the filing of the correspondence and other related action.

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaii Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee.
