AMENDING CHAPTERS 2.28 AND 2.40, MAUI COUNTY CODE, RELATING TO ADVISORY COMMITTEES TO THE MAUI PLANNING COMMISSION (GREAT-30)
Description
The Committee is in receipt of the following:
1. County Communication 19-402, from Councilmember Kelly T. King, transmitting a proposed bill amending Chapters 2.28 and 2.40, Maui County Code, relating to advisory committees to the Maui Planning Commission.
2. Correspondence dated March 5, 2021, from Committee Chair Michael J. Molina, transmitting a revised proposed bill entitled "A BILL FOR AN ORDINANCE AMENDING CHAPTERS 2.28 AND 2.40, MAUI COUNTY CODE, RELATING TO ADVISORY COMMITTEES TO THE MAUI PLANNING COMMISSION." The purpose of the revised proposed bill is to amend Chapters 2.28 and 2.40, Maui County Code, to: (1) establish Kihei-Makena and Paia-Haiku advisory committees to the Maui Planning Commission; (2) require an advisory committee member must be a resident of the relevant community plan area for a period of at least twelve months immediately preceding the person's appointment; (3) require each advisory committee to consist of seven members, of which two members are appointed by the Mayor, and five members are appointed by the Council; (4) establish processes for filling vacancies for advisory committee members who cease to be residents of the relevant community plan area, and staggering of board terms; and (5) require each advisory committee to provide recommendations to the Maui Planning Commission, upon request, on matters within its community plan area, including holding public hearings and adopting administrative rules; however, recommendations must be provided within 90 days for matters requested for review by the Maui Planning Commission.
Status
The Committee may consider whether to recommend passage of the revised proposed bill in paragraph two on first reading, with or without further revisions. The Committee may also consider the filing of County Communication 19-402 and other related action....
