PROPOSED FISCAL YEAR 2022 BUDGET FOR THE COUNTY OF MAUI  (BFED-1)

 

 

Description

The Committee is in receipt of the following:

1.                     County Communication 21-30, from Council Vice-Chair Keani N.W. Rawlins-Fernandez, relating to the Fiscal Year (“FY”) 2022 Budget.

 

2.                     County Communication 21-173, from Mayor Michael P. Victorino, relating to the proposed FY 2022 Budget for the County of Maui.  Included in the Mayor’s transmittal are the following:

 

a.                     A proposed bill entitled “A BILL FOR AN ORDINANCE RELATING TO THE OPERATING BUDGET FOR THE COUNTY OF MAUI FOR THE FISCAL YEAR JULY 1, 2021 TO JUNE 30, 2022.”  The purpose of the proposed bill is to appropriate estimated revenues for the operating and capital improvement budget.  Incorporated within the proposed bill are Appendix A, which lists Grants and Restricted Use Revenues and Special Purpose Revenues; Appendix B, which is the Schedule of Fees, Rates, Assessments, and Taxes; Appendix B-1, which lists the County’s concessions, leases, and licenses by department; and Appendix C, which provides descriptions of Capital Improvement Projects (“Budget bill”).

 

b.                     A proposed bill entitled “A BILL FOR AN ORDINANCE RELATING TO THE CAPITAL PROGRAM FOR THE FISCAL YEAR ENDING JUNE 30, 2022.”  The purpose of the proposed bill is to set forth the Capital Program for FY 2022 through 2027.  Incorporated within the proposed bill are Appendix A-1, a report entitled “COUNTY OF MAUI, CAPITAL IMPROVEMENT PROJECTS REPORT, AS OF DECEMBER 31, 2020,” which lists all pending capital improvement projects and appropriations, except for Water Fund projects, as of December 31, 2020; Appendix A-2, a report entitled “County of Maui, Capital Improvement Program by District Job and Index, Fiscal Year Ending 6/30/2021 - as of 12/31/2020,” which includes pending Water Fund capital improvement projects and appropriations as of December 31, 2020; and Appendix B, which is the proposed Capital Program for FY 2022 through 2027 (“Capital Program bill”).

 

c.                     A proposed bill entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE ISSUANCE OF EIGHTY-FIVE MILLION, FIVE HUNDRED EIGHTY THOUSAND, NINE HUNDRED DOLLARS ($85,580,900) AGGREGATE PRINCIPAL AMOUNT OF GENERAL OBLIGATION BONDS OF THE COUNTY OF MAUI FOR THE PURPOSE OF PROVIDING FUNDS TO PAY ALL OR A PART OF THE COST OF APPROPRIATIONS FOR PUBLIC IMPROVEMENTS OF AND FOR THE COUNTY OF MAUI; FIXING THE FORM, DENOMINATIONS AND CERTAIN OTHER FEATURES OF SUCH BONDS AND PROVIDING FOR THEIR SALE; AUTHORIZING THE DIRECTOR OF FINANCE TO DETERMINE CERTAIN DETAILS OF THE BONDS; AUTHORIZING THE ISSUANCE AND SALE OF A LIKE PRINCIPAL AMOUNT OF GENERAL OBLIGATION BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE AND SALE OF SUCH BONDS; AUTHORIZING THE ISSUANCE OF REFUNDING GENERAL OBLIGATION BONDS OF THE COUNTY; AND PROVIDING FOR OTHER ACTIONS RELATED TO THE ISSUANCE, SALE AND DELIVERY OF SAID BONDS.”  The purpose of the proposed bill is to authorize the issuance of $85,580,900 in general obligation bonds for various capital improvement projects (“Bond Authorization bill”).

 

d.                     A proposed bill entitled “A BILL FOR AN ORDINANCE DETERMINING THAT PART OF THE PROCEEDS OF GENERAL OBLIGATION BONDS OF THE COUNTY OF MAUI HERETOFORE ISSUED IS IN EXCESS OF THE AMOUNTS REQUIRED FOR THE PURPOSES FOR WHICH SUCH BONDS WERE INITIALLY ISSUED, OR MAY OR SHOULD NOT BE APPLIED TO THOSE PURPOSES, AND DIRECTING SUCH PROCEEDS TO OTHER PUBLIC IMPROVEMENTS OR AUTHORIZED PURPOSES OF THE COUNTY OF MAUI.”  The purpose of the proposed bill is to reauthorize the use of $1,872,000 in lapsed bond proceeds for the Department of Management, Wailuku-Kahului Community Plan Area, Government Facilities, 60 North Church Street Building Renovation (“Lapsed Bond bill”).

 

e.                     A proposed bill entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE MAYOR OF THE COUNTY OF MAUI TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR A LOAN FROM THE STATE OF HAWAII’S WATER POLLUTION CONTROL REVOLVING FUND FOR VARIOUS WASTEWATER PROJECTS, FISCAL YEAR 2022 BUDGET ORDINANCE.”  The purpose of the proposed bill is to authorize the Mayor to enter into an intergovernmental agreement to finance various wastewater projects, with funds not to exceed $12,900,000.

 

f.                     A proposed bill entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE MAYOR OF THE COUNTY OF MAUI TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR A LOAN FROM THE STATE OF HAWAII’S DRINKING WATER TREATMENT REVOLVING LOAN FUND FOR WEST MAUI SOURCE DEVELOPMENT, FISCAL YEAR 2022 BUDGET ORDINANCE.”  The purpose of the proposed bill is to authorize the Mayor to enter into an intergovernmental agreement to finance the West Maui Source Development, with funds not to exceed $4,250,000.

 

g.                     A proposed bill entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 3.38.020, MAUI COUNTY CODE, RELATING TO THE HAWAIIAN CULTURAL RESTORATION AND REVOLVING FUND.”  The purpose of the proposed bill is to amend Section 3.38.020, Maui County Code, to allow funds to be used for the preservation and restoration of Kamehameha Iki Park, Lahaina, Maui, Hawaii.

 

h.                     A proposed bill entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 3.81, MAUI COUNTY CODE, RELATING TO ECONOMIC DEVELOPMENT AND CULTURAL PROGRAMS REVOLVING FUND.”  The purpose of the proposed bill is to amend Chapter 3.81, Maui County Code, to include cultural programs and remove the expiration date of the fund.

 

i.                     A proposed resolution entitled “ADOPTING THE FUEL TAX RATES FOR THE COUNTY OF MAUI, EFFECTIVE JULY 1, 2021.”  The purpose of the proposed resolution is to adopt the fuel tax rates for the County of Maui, effective July 1, 2021, in accordance with Section 243-5, Hawaii Revised Statutes (“HRS”), and Section 3.20.010, Maui County Code.

 

j.                     A proposed resolution entitled “AUTHORIZING THE ACQUISITION OF REAL PROPERTY IDENTIFIED AS TAX MAP KEY NOS. (2) 4-6-011:011 AND (2) 4-6-011:028, SITUATED IN LAHAINA, MAUI, HAWAII, FOR AN AMOUNT NOT TO EXCEED $650,000.”  The purpose of the proposed resolution is to authorize the acquisition of approximately 9,097 and 1,500 square feet of real property identified as tax map key numbers (2) 4-6-011:011 and (2) 4-6-011:028, respectively, Lahaina, Maui, Hawaii, for an amount not to exceed $650,000.

 

k.                     Booklets entitled “FY 2022 PROPOSED BUDGET SYNOPSIS”; and “BUDGET PROPOSAL FY 2022,” which includes the Mayor’s Budget Message (“Program Budget”).

 

3.                     Correspondence dated April 7, 2021, from the Director of Council Services, transmitting the following:

 

a.                     A proposed bill entitled “A BILL FOR AN ORDINANCE ESTABLISHING A DEPUTY DIRECTOR OF COUNCIL SERVICES AND REVISING PAY RANGES FOR COUNCIL SERVICES STAFF.”  The purpose of the proposed bill is to amend Section 2.08.010, Maui County Code, establishing a Deputy Director of Council Services and revising pay ranges for Council Services Staff.

 

b.                     A proposed resolution entitled “APPOINTING DAVID M. RAATZ, JR., THE DEPUTY DIRECTOR OF COUNCIL SERVICES AND SETTING THE SALARY.”  The purpose of the proposed resolution is to appoint and set the salary of the Deputy Director of Council Services.

 

c.                     A proposed resolution entitled “AMENDING RESOLUTION 21-10 TO AUTHORIZE ANNUAL STEP INCREASES FOR EMPLOYEES IN THE OFFICE OF COUNCIL SERVICES.”  The purpose of the proposed resolution is to amend Resolution 21-10, relating to annual step increases for employees in the Office of Council Services.

 

 

4.                     Correspondence dated April 8, 2021, from Councilmember Tamara Paltin, transmitting a proposed bill entitled “A BILL FOR AN ORDINANCE RELATING TO A VACANCY TAX.”  The purpose of the proposed bill is to establish a policy supporting a vacancy tax.

 

5.                     Correspondence dated April 9, 2021, from Councilmember Yuki Lei K. Sugimura, transmitting the following:

 

a.                     A proposed bill entitled “A BILL FOR AN ORDINANCE ESTABLISHING A NEW CHAPTER 3.41, MAUI COUNTY CODE, CREATING THE KULA AGRICULTURAL PARK REVOLVING FUND.”  The purpose of the proposed bill is to establish a new Chapter 3.41, Maui County Code, for the Kula Agricultural Park Revolving Fund.

 

b.                     A proposed bill entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 3.34, MAUI COUNTY CODE, RELATING TO THE HOME ACQUISITION AND OWNERSHIP PROGRAMS REVOLVING FUND.”  The purpose of the proposed bill is to amend Section 3.34.020, Maui County Code, to add an individual development account program under the Home Acquisition and Ownership Programs Revolving Fund.

 

6.                     Correspondence dated April 12, 2021, from the Department of the Corporation Counsel, transmitting a proposed bill entitled “A BILL FOR AN ORDINANCE RELATING TO THE REAL PROPERTY TAX LONG-TERM RENTAL CLASSIFICATION.”  The purpose of the proposed bill is to amend Section 3.48.561(B), Maui County Code, to establish tiers for the real property tax long-term classification.

 

Status

The Committee may consider whether to recommend passage of the proposed bills on first reading, with or without revisions.  The Committee may consider whether to recommend adoption of the proposed resolutions, with or without revisions.  The Committee may also consider the development of other legislation related to the proposed budget for FY 2022.  The Committee may also consider the filing of County Communications 21-30, 21-173, and other correspondence, and other related action.

 

Note

 

With reference to this agenda item, one or more executive meetings in accordance with Section 92-5(a), HRS, may be held:

(1)                     to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in Section 26-9, HRS, or both;

(2)                     to consider the hire, evaluation, dismissal, or discipline of an officer or employee or of charges brought against the officer or employee, where consideration of matters affecting privacy will be involved; provided that if the individual concerned requests an open meeting, an open meeting shall be held;

(3)                     to deliberate concerning the authority of persons designated by the County, the Council, or the Committee to conduct labor negotiations or to negotiate the acquisition of public property, or during the conduct of such negotiations;

(4)                     to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee;

(5)                     to investigate proceedings regarding criminal misconduct;

(6)                     to consider sensitive matters related to public safety or security;

(7)                     to consider matters relating to the solicitation and acceptance of private donations; and

(8)                     to deliberate or make a decision upon a matter that requires the consideration of information that must be kept confidential pursuant to a State or Federal law, or a court order.
