LITIGATION MATTERS (SPECIAL COUNSEL AUTHORIZATION:  RETENTION OF THE OFFICE OF THE CORPORATION COUNSEL, COUNTY OF HAWAII, AS SPECIAL COUNSEL IN THE MATTER OF ARBITRATIONS BETWEEN THE HAWAII GOVERNMENT EMPLOYEES ASSOCIATION, AFSCME, LOCAL 152, AFL-CIO AND THE COUNTY OF MAUI)  (GREAT-11(29))

 

Description

The Committee is in receipt of correspondence dated April 29, 2021, from the Department of the Corporation Counsel, transmitting a proposed resolution entitled “AUTHORIZING THE ASSISTANCE OF THE OFFICE OF THE CORPORATION COUNSEL, COUNTY OF HAWAII, TO ACT AS SPECIAL COUNSEL IN VARIOUS GRIEVANCES BROUGHT AGAINST THE COUNTY BY A HGEA BARGAINING UNIT 13 EMPLOYEE DUE TO CONFLICTS OF INTEREST.”  The purpose of the proposed resolution is to authorize the employment of the Office of the Corporation Counsel, County of Hawaii, as special counsel, representing the County of Maui in various grievances before an arbitrator involving an HGEA Bargaining Unit 13 employee, due to conflicts of interest for the Department of the Corporation Counsel, County of Maui, for an amount not to exceed $5,000.

 

Status

The Committee may consider whether to recommend adoption of the proposed resolution, with or without revisions.  The Committee may also consider the filing of the correspondence and other related action.

 

Note

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaii Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, immunities, and liabilities of the County, the Council, and the Committee.
