LITIGATION MATTERS (RESOLUTION 22-52, RELATING TO SETTLEMENT AUTHORIZATION: TYRON DELLA; CLAIM 4064548 (MOTOR VEHICLE ACCIDENT)) (GREAT-11(13))
Description
The Committee is in receipt of the following:
1. Resolution 22-52, entitled “AUTHORIZING SETTLEMENT OF CLAIM NO. 4064548 OF TYRON DELLA.” Resolution 22-52’s purpose is to authorize settlement of the claim filed on September 10, 2021.
2. Correspondence dated February 18, 2022, from the County Clerk, with a letter from the Department of the Corporation Counsel, dated February 4, 2022, transmitting a copy of the claim. The claim alleges injuries and damages to the Plaintiff’s vehicle sustained at the intersection of Ka‘ahumanu and Wahine Pio Avenues in Kahului, Maui, Hawai‘i, on February 25, 2020, involving a Maui County fleet vehicle being operated by a County employee.
Status
The Committee may consider whether to recommend adoption of Resolution 22-52, with or without revisions. The Committee may also consider the filing of Resolution 22-52 and other related action.

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaii Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, immunities, and liabilities of the County, the Council, and the Committee.
