RESOLUTION 22-161, RELATING TO SETTLEMENT AUTHORIZATION: RONDA SMYTHE AND LIANA P. KANNO V. BRANDON SAFFEELS, ET AL., CIVIL CASE 21-00056 LEK-RT AND ALISHA N.K. CONSTANTINO V. BRANDON SAFFEELS, ET AL., CIVIL CASE 21-00316 LEK-RT  (GREAT-11(25))

 

Description

The Committee is in receipt of the following:

1.                     Resolution 22-161, entitled “AUTHORIZING SETTLEMENT OF RONDA SMYTHE AND LIANA P. KANNO V. BRANDON SAFFEELS, ET AL., CASE CV 21-00056 LEK-RT AND ALISHA N.K. CONSTANTINO V. BRANDON SAFFEELS, ET AL., CASE CV 21-00316 LEK-RT.”  Resolution 22-161’s purpose is to authorize settlement of the claim filed on May 3, 2021.

2.                     Correspondence dated July 5, 2022, from the County Clerk, with a letter from the Department of the Corporation Counsel, dated June 16, 2022, transmitting a copy of the claim.  The claim alleges various acts of misconduct committed by former police officer Brandon Saffeels and further brings claims against the County of Maui for an alleged failure to train and supervise former officer Saffeels.

 

Status

The Committee may consider whether to recommend adoption of Resolution 22-161, with or without revisions.  The Committee may also consider the filing of Resolution 22-161 and other related action.

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaii Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, immunities, and liabilities of the County, the Council, and the Committee.
