Title

RESOLUTION 22-109, RELATING TO SETTLEMENT AUTHORIZATION:  DONALD S. GUZMAN V. COUNTY OF MAUI, ET AL., CIVIL 21-00202 DKW-RT  (GREAT-11(22))

 

Description

The Committee is in receipt of the following:

1.                     Resolution 22-109, entitled “AUTHORIZING SETTLEMENT OF DONALD S. GUZMAN V. COUNTY OF MAUI, ET AL., CIVIL NO. 21-00202 DKW-RT.”  Resolution 22-109’s purpose is to authorize settlement of the claim filed on April 23, 2021.

2.                     Correspondence dated May 9, 2022, from the County Clerk, with a letter from the Department of the Corporation Counsel, dated April 20, 2022, transmitting a copy of the claim.  The claim alleges the Plaintiff’s rights to privacy and due process under the United States Constitution were violated in accordance with 42 U.S.C. § 1983 and that the Plaintiff was discriminated against based on a disability in accordance with Hawaii Revised Statutes § 378-2(a)(1)(A).

 

Status

The Committee may consider whether to recommend adoption of Resolution 22-109, with or without revisions.  The Committee may also consider the filing of Resolution 22-109 and other related action.

 

Note

With reference to this agenda item, one or more executive meetings are anticipated in accordance with Section 92-5(a)(4), Hawaii Revised Statutes, to consult with legal counsel on questions and issues pertaining to the powers, duties, immunities, and liabilities of the County, the Council, and the Committee.
