Title

BILL 103 (2022), RELATING TO RESIDENTIAL WORKFORCE HOUSING DEED RESTRICTIONS AND RESALE  (AH-31)

 

Description

The Committee is in receipt of the following:

1.                     Bill 103 (2022), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.96.060, MAUI COUNTY CODE, RELATING TO RESIDENTIAL WORKFORCE HOUSING DEED RESTRICTIONS AND RESALE.”  Bill 103’s purpose is to amend residential workforce housing deed restrictions to require units be sold to owner-occupants in perpetuity and to increase the time-period for all other restrictions.

2.                     Correspondence dated October 28, 2022, from the Committee Chair, transmitting a proposed amendment.  The purpose of the proposed amendment is to amend Bill 103 (2022) to specify that affordable housing projects under Chapter 201H, Hawaiʻi Revised Statutes, must comply with requirements of Chapter 2.96, Maui County Code.  When Chapter 201H and Chapter 2.96 are in conflict, Chapter 201H will control, except Chapter 201H projects must comply with Section 2.96.060(B)(4).

 

Status

The Committee may consider whether to recommend passage of Bill 103 (2022) on first reading, with or without revisions.  The Committee may also consider whether to recommend the filing of Bill 103 (2022) and other related action.
