PROPOSED FISCAL YEAR 2024 BUDGET FOR THE COUNTY OF MAUI  (BFED-1)

 

Description

The Committee is in receipt of the following:

1.                     Correspondence from Mayor Richard T. Bissen, Jr. dated March 24, 2023, relating to the proposed Fiscal Year (“FY”) 2024 Budget for the County of Maui.  Included in this transmittal are the following:

a.                     Bill 22 (2023), entitled “A BILL FOR AN ORDINANCE RELATING TO THE OPERATING BUDGET FOR THE COUNTY OF MAUI FOR THE FISCAL YEAR JULY 1, 2023, TO JUNE 30, 2024.”  Bill 22’s purpose is to appropriate estimated revenues for the operating and capital improvement budget.  Incorporated within the proposed bill are Appendix A, which lists Grants and Restricted Use Revenues and Special Purpose Revenues; Appendix B, which is the Schedule of Fees, Rates, Assessments, and Taxes; Appendix B-1, which lists the County’s concessions, leases, and licenses by department; and Appendix C, which provides descriptions of Capital Improvement Projects (“Budget bill”).

b.                     Bill 23 (2023), entitled “A BILL FOR AN ORDINANCE RELATING TO THE CAPITAL PROGRAM FOR THE FISCAL YEAR ENDING JUNE 30, 2024.”  Bill 23’s purpose is to set forth the Capital Program for FYs 2024 through 2029.  Incorporated within the proposed bill are Appendix A-1, a report entitled “COUNTY OF MAUI, CAPITAL IMPROVEMENT PROJECTS REPORT, AS OF DECEMBER 31, 2022,” which lists all pending capital improvement projects and appropriations, except for Water Fund projects, as of December 31, 2022; Appendix A-2, a report entitled “County of Maui, Capital Improvement Program by District Job and Index, Fiscal Year Ending 6/30/2023 - as of 12/31/2022,” which includes pending Water Fund capital improvement projects and appropriations as of December 31, 2022; and Appendix B, which is the proposed Capital Program for FYs 2024 through 2029 (“Capital Program bill”).

c.                     Bill 24 (2023), entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE ISSUANCE OF SIXTY-FIVE MILLION NINE HUNDRED FORTY-FIVE THOUSAND FORTY-THREE DOLLARS ($65,945,043) AGGREGATE PRINCIPAL AMOUNT OF GENERAL OBLIGATION BONDS OF THE COUNTY OF MAUI FOR THE PURPOSE OF PROVIDING FUNDS TO PAY ALL OR A PART OF THE COST OF APPROPRIATIONS FOR PUBLIC IMPROVEMENTS OF AND FOR THE COUNTY OF MAUI; FIXING THE FORM, DENOMINATIONS AND CERTAIN OTHER FEATURES OF SUCH BONDS AND PROVIDING FOR THEIR SALE; AUTHORIZING THE DIRECTOR OF FINANCE TO DETERMINE CERTAIN DETAILS OF THE BONDS; AUTHORIZING THE ISSUANCE AND SALE OF A LIKE PRINCIPAL AMOUNT OF GENERAL OBLIGATION BOND ANTICIPATION NOTES IN ANTICIPATION OF THE ISSUANCE AND SALE OF SUCH BONDS; AUTHORIZING THE ISSUANCE OF REFUNDING GENERAL OBLIGATION BONDS OF THE COUNTY; AND PROVIDING FOR OTHER ACTIONS RELATED TO THE ISSUANCE, SALE AND DELIVERY OF SAID BONDS.”  Bill 24’s purpose is to authorize the issuance of $65,945,043 in general obligation bonds for various capital improvement projects (“Bond Authorization bill”).

d.                     Bill 25 (2023), entitled “A BILL FOR AN ORDINANCE DETERMINING THAT PART OF THE PROCEEDS OF GENERAL OBLIGATION BONDS OF THE COUNTY OF MAUI HERETOFORE ISSUED IS IN EXCESS OF THE AMOUNTS REQUIRED FOR THE PURPOSES FOR WHICH SUCH BONDS WERE INITIALLY ISSUED, OR MAY OR SHOULD NOT BE APPLIED TO THOSE PURPOSES, AND DIRECTING SUCH PROCEEDS TO OTHER PUBLIC IMPROVEMENTS OR AUTHORIZED PURPOSES OF THE COUNTY OF MAUI.”  Bill 25’s purpose is to reauthorize the use of $2,349,957 in lapsed bond proceeds for the Department of Management, Wailuku-Kahului Community Plan Area, Government Facilities, 60 South Church Street Building Renovations (“Lapsed Bond bill”).

e.                     Bill 26 (2023), entitled “A BILL FOR AN ORDINANCE AUTHORIZING THE MAYOR OF THE COUNTY OF MAUI TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT FOR A LOAN FROM THE STATE OF HAWAII’S WATER POLLUTION CONTROL REVOLVING FUND FOR VARIOUS WASTEWATER PROJECTS, FISCAL YEAR 2024 BUDGET ORDINANCE.”  Bill 26’s purpose is to authorize the Mayor to enter into an intergovernmental agreement to finance the Napili Wastewater Pump Station No. 3 Modifications and the Kaanapali Resort R-1 Water Distribution System Expansion with funds not to exceed $9,100,000.

f.                     Resolution 23-117, entitled “ADOPTING THE FUEL TAX RATES FOR THE COUNTY OF MAUI, EFFECTIVE JULY 1, 2023.”  Resolution 23-117’s purpose is to adopt the fuel tax rates for the County of Maui, effective July 1, 2023, in accordance with Section 243-5, Hawaii Revised Statutes, and Section 3.20.010, Maui County Code.

2.                     Bill 27 (2023), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 3.36.100, MAUI COUNTY CODE, RELATING TO THE REIMBURSEMENT OF COUNTY GRANTEES.”  Bill 27’s purpose is to authorize the County to reimburse grantees for expenses that pre-date the contract’s execution date, if the funds are expended in the same fiscal year that the contract is encumbered.

3.                     Bill 36 (2023), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 2.08.060, MAUI COUNTY CODE, TO REVISE THE PAY PLAN AND RANGES IN THE OFFICE OF COUNCIL SERVICES.”  Bill 36’s purpose is to add three new position titles: Senior council services technician, project assignment specialist, and council services assistant  (full-time); two new pay ranges; and institute a five percent pay increase for all pay ranges and steps.

4.                     Resolution 23-123, entitled “SUSPENDING THE PROVISIONS OF SUBSECTION 2.08.060(D), MAUI COUNTY CODE, FOR FISCAL YEAR 2024.”  Resolution 23-123’s purpose is to suspend all provisions of Subsection 2.08.060(D) for FY 2024.

5.                     Resolution 23-124, entitled “SETTING THE PAY RANGES AND PAY STEPS FOR STAFF OF THE OFFICE OF COUNCIL SERVICES.”  Resolution 23-124’s purpose is to set the pay ranges and pay steps for two senior council services technicians, one council services assistant (full-time), and one senior accountant.

6.                     Bill 37 (2023), entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 3.81, MAUI COUNTY CODE, TO ESTABLISH A DEDICATED FUNDING SOURCE FOR THE ECONOMIC DEVELOPMENT AND CULTURAL PROGRAMS REVOLVING FUND.”  Bill 37’s purpose is to amend Section 3.81.030, Maui County Code to enable the Council to appropriate a minimum of two percent of the certified real property tax revenues, not to exceed $10,000,000 in any one fiscal year.

7.                     Bill 38 (2023), entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 3.34, MAUI COUNTY CODE, TO CREATE AND FUND AN ‘OHANA ASSISTANCE PILOT PROGRAM.”  Bill 38’s purpose is to create and fund an ‘ohana assistance pilot program to offer grants of up to $50,000 to property owners to build an accessory dwelling or second form dwelling for permanent long-term occupancy as residential workforce housing units.

 

Status

The Committee may consider whether to recommend passage on first reading of each of the following bills with or without revisions: Bill 22 (2023), Bill 23 (2023), Bill 24 (2023), Bill 25 (2023), Bill 26 (2023), Bill 27 (2023), Bill 36 (2023), Bill 37 (2023), and Bill 38 (2023).  The Committee may also consider whether to recommend adoption of the following resolutions with or without revisions: Resolution 23-117, Resolution 23-123, and Resolution 23-124.  The Committee may also consider the development of other legislation related to the proposed budget for FY 2024.  The Committee may also consider whether to recommend the filing of Bill 22 (2023), Bill 23 (2023), Bill 24 (2023), Bill 25 (2023), Bill 26 (2023), Bill 27 (2023), Bill 36 (2023), Bill 37 (2023), Bill 38 (2023), Resolution 23-117, Resolution 23-123, and Resolution 23-124 and other related action.

 

Note

With reference to this agenda item, one or more executive meetings may be held in accordance with Section 92-5(a), Hawaii Revised Statutes (“HRS”):

(1)                     to consider and evaluate personal information relating to individuals applying for professional or vocational licenses cited in Section 26-9, HRS, or both;

(2)                     to consider the hire, evaluation, dismissal, or discipline of an officer or employee or of charges brought against the officer or employee, where consideration of matters affecting privacy will be involved; provided that if the individual concerned requests an open meeting, an open meeting shall be held;

(3)                     to deliberate concerning the authority of persons designated by the County, the Council, or the Committee to conduct labor negotiations or to negotiate the acquisition of public property, or during the conduct of such negotiations;

(4)                     to consult with legal counsel on questions and issues pertaining to the powers, duties, privileges, immunities, and liabilities of the County, the Council, and the Committee;

(5)                     to investigate proceedings regarding criminal misconduct;

(6)                     to consider sensitive matters related to public safety or security;

(7)                     to consider matters relating to the solicitation and acceptance of private donations; and

(8)                     to deliberate or make a decision upon a matter that requires the consideration of information that must be kept confidential pursuant to a State or Federal law, or a court order.
