WELLHEAD PROTECTION OVERLAY DISTRICT  (HLU-10)

 

Description

The Committee is in receipt of the following:

1.                     County Communication 15-50, from the Director of Water Supply, transmitting a proposed bill to protect the County’s groundwater sources from contamination by establishing a zoning overlay district to be known as the Wellhead Protection Overlay District.

2.                     Correspondence dated January 4, 2019, from the Acting Planning Director, providing comments from the Maui, Molokai, and Lānaʻi Planning Commissions on the proposed bill, entitled “A BILL FOR AN ORDINANCE AMENDING TITLE 19, MAUI COUNTY CODE, TO ESTABLISH A WELLHEAD PROTECTION OVERLAY DISTRICT,” transmitted via Resolution 18-149.

3.                     Correspondence dated October 31, 2023, from the Director of Water Supply, transmitting a revised proposed bill, approved as to form and legality by the Department of the Corporation Counsel, entitled “A BILL FOR AN ORDINANCE AMENDING TITLE 19, MAUI COUNTY CODE, TO ESTABLISH A WELLHEAD PROTECTION OVERLAY DISTRICT.”  The revised proposed bill’s purpose is to protect the County’s groundwater sources by establishing a zoning overlay district to be known as the Wellhead Protection Overlay District.

 

Status

The Committee may consider whether to recommend passage on first reading of the revised proposed bill noted in paragraph 3, with or without further revisions.  The Committee may also consider the filing of County Communication 15-50 and other related action.
