Title

BILL 52 (2022), PROHIBITED DISCHARGE STANDARDS  (ADEPT-4)

 

Description

The Committee is in receipt of the following:

1.                     Bill 52 (2022), entitled “A BILL FOR AN ORDINANCE AMENDING SECTION 14.21A.015, MAUI COUNTY CODE, RELATING TO PROHIBITED DISCHARGE STANDARDS.”  Bill 52’s purpose is to update municipal wastewater standards for wastewater discharged and reused by the County and to provide sufficient funding for its implementation.

2.                     An Amendment Summary Form for the November 30, 2023, Committee meeting from Committee Chair Gabe Johnson with a proposed CD1 version of Bill 52 (2022), entitled “A BILL FOR AN ORDINANCE RELATING TO PROHIBITED DISCHARGE STANDARDS.”  The proposed CD1 version 1) amends Section 14.02.030, Maui County Code, to allow the Water Use and Development Plan to serve as a guide to the Council, the Department of Water Supply, and all other County agencies in the creation and approval of the County’s annual capital improvement program to implement recommendations and strategies for the development of reclaimed water infrastructure and alternative water sources; 2) amends Section 20.30.020, Maui County Code, to require municipal wastewater effluent produced by the County to meet Hawaiʻi State R-1 reuse water standards starting January 1, 2039; and 3) amends Section 20.30.030, Maui County Code, to amend the definition of “available reclaimed water service” to mean the existence of a reclaimed water distribution main contiguous to or within two hundred fifty feet of any consumer’s property line.

 

Status

The Committee may consider whether to recommend passage of Bill 52 (2022) on first reading, with or without revisions.  The Committee may also consider the filing of Bill 52 (2022) and other related action.
