Title

BILL 21 (2024), AMENDING CHAPTER 16.25, MAUI COUNTY CODE, RELATING TO SECTION 105 PERMITS OF THE BUILDING CODE ADMINISTRATIVE AND SUPPLEMENTAL PROVISIONS  (WAI-19)

 

Description

The Committee is in receipt of the following:

1.                     Bill 21 (2024), entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 16.25, MAUI COUNTY CODE, RELATING TO SECTION 105 PERMITS OF THE BUILDING CODE ADMINISTRATIVE AND SUPPLEMENTAL PROVISIONS.”  Bill 21’s purpose is to broaden the applicability of the emergency repair provisions and clarify the review and approval procedures for issuing emergency repair permits to expedite the recovery of housing, public facilities, and businesses in Lahaina and Upcountry due to the August 2023 wildfires.  Bill 21 would apply to future proclamations of emergency or disaster.

2.                     An Amendment Summary Form received on February 2, 2024, from Committee Chair Cook, transmitting a proposed CD1 version of Bill 21 (2024), entitled “A BILL FOR AN ORDINANCE AMENDING CHAPTER 16.25, MAUI COUNTY CODE, RELATING TO EMERGENCY BUILDING PERMITS.”  The proposed CD1 version of Bill 21 (2024) amends the bill’s title, inserts that driveway and grading permits may be consolidated under a modified application, inserts a new section “L. Indemnification,” expands the building official’s ability to withhold issuing a modified application permit if pending public infrastructure improvements adjacent to the property are necessary, and incorporates nonsubstantive revisions.

 

Status

The Committee may consider whether to recommend passage of the proposed CD1 version of Bill 21 (2024) on first reading, with or without further revisions.  The Committee may also consider the filing of Bill 21 (2024) and other related action.
