LITIGATION MATTERS (RESOLUTION 24-162, AUTHORIZING SETTLEMENT OF JULIEANN NAKI, INDIVIDUALLY, AND AS SPECIAL ADMINISTRATOR OF THE ESTATE OF NATHANIEL JOSHUA NA WAʻE WAʻE MAKALA KA KAI NAKI, ET AL. V. COUNTY OF MAUI, ET AL., CIVIL CV-23-00383-HG-WRP)  (GREAT-11(49))

 

Description

The Committee is in receipt of the following:

1.                     Resolution 24-162, entitled “AUTHORIZING SETTLEMENT OF JULIEANN NAKI, INDIVIDUALLY, AND AS SPECIAL ADMINISTRATOR OF THE ESTATE OF NATHANIEL JOSHUA NA WAʻE, WAʻE MAKALA KA KAI NAKI, ET AL. V. COUNTY OF MAUI, ET AL., CIVIL CV-23-00383-HG-WRP.”  Resolution 24-162’s purpose is to approve settlement of the claim, filed on September 14, 2023.  The claim alleges that Defendant police officers, Department of Police, County of Maui, unlawfully shot Nathaniel Na Waʻe Waʻe Makala Ka Kai Naki (“Decedent”) on April 30, 2023, on the island of Molokai, Hawai‘i, and that the injuries suffered resulted in the Decedent’s death.

2.                     Correspondence dated September 20, 2024, from the Department of the Corporation Counsel, transmitted a copy of the Second Amended Complaint, filed on March 1, 2024.

 

Status

The Committee may consider whether to recommend adoption of Resolution 24-162, with or without revisions.  The Committee may also consider the filing of Resolution 24-162 and other related action.

 

Note
