CONFLICTS BETWEEN CHAPTER 2.96, MCC, RELATING TO THE RESIDENTIAL WORKFORCE HOUSING POLICY, AND CHAPTER 3.35, MCC, RELATING TO THE AFFORDABLE HOUSING FUND  (AH-23)

 

Description

The Committee is in receipt of a Miscellaneous Communication, dated May 17, 2019, from the County Clerk, transmitting the matter relating to conflicts between Chapters 2.96 and 3.35 of the Maui County Code, relating to the Residential Workforce Housing Policy and the Affordable Housing Fund, respectively.  Chapter 3.35’s criteria for obtaining Affordable Housing Fund financing include demonstrating “the project directly advances the objective of providing affordable housing in perpetuity.”  Chapter 3.35 also states that units financed by the Affordable Housing Fund are subject to Chapter 2.96’s affordability requirements of 5-30 years.

 

Status

The Committee may discuss the conflicts between Chapters 2.96 and 3.35 and related matters.  The Committee may also consider the filing of the Miscellaneous Communication and other related action.
